Under the authority of Section 1135 of the Social Security Act, the U.S. Centers for Medicare and Medicaid Services (CMS) issued several temporary emergency statutory and regulatory waivers and flexibilities to help providers respond to the COVID-19 Public Health Emergency (PHE). These waivers expired on May 11, 2023.
Prior to the expiration of the Section 1135 Waivers, CMS issued detailed guidance outlining the timeline for expiration of each specific waiver, by provider type.
